Our client was divorced from her husband in 2015 and only then learned about her IRS debt in the amount of $49,000.00 and the Illinois Department of Revenue debt in the amount of $13,500.00. They filed their divorce prosay meaning without an attorney, and used form language that they found on the internet, which is not advisable. As a result, the divorce decree said that the tax debt is 50/50 between the ex-spouses. Unfortunately, her ex cannot keep a job and our client is gainfully employed. Although the IRS is currently asleep, the State of Illinois has now demanded payment of the $13,500.00 in past due taxes. To make things worse, a prior tax representative told her that she was not entitled to seek Innocent Spouse Relief, which is not true. We provided direction to our client on the Illinois Department of Revenue matters and she was pleased with our advice.
